[sharechat] DFMTrade drama

Well this will keep me actively reading the forum for the next few weeks.

Suing (or threatening to) potential customers is never a promising strategy,
and it would be nice to see a more reasoned response from DFM, maybe even
incorporating the words "over" "reaction" and ... "sorry". If the legalese
is cut out of the original posting it makes DFM's point quite well.

On another note, this does have parallels with other chatroom/public forum
legal issues. I think the main difference between this and the
Slashdot/Microsoft/Kerberos case (in which MS is trying to sue Slashdot to
get "trade secret" postings removed) is that Sharechat doesn't explicitly
spell out who owns the postings.

I take the view that I own this posting, and while Sharechat is the medium
in this case, I believe they are only as responsible for my opinions as the
ISP, telephone company, and electricity company (for example). In other
words, not responsible at all.

Like many others here, I'll be interested about NZ law's opinion on that.

On the other hand, I'm sure ril would be miffed if sharechat made millions
by publishing a book of his posts, but that seems to be possible under the
current T&C. I'd never looked at them closely before, and I'm not ascribing
bad intent, but the unlimited reproduction rights go a bit far IMO. Could we
trim that a bit Ben?

I'd like to retain the ownership and copyright of my messages, while still
allowing sharechat to delete them if they wish :-)
